Your memories are personal. Momentina is designed to give you control over how you organize, store and share them.

1. Introduction

This Privacy Policy explains how Momentina ("Momentina", "we", "us", or "our") collects, uses, stores and protects information when you use the Momentina mobile application, website and related services (collectively, the "Service").

Momentina is a service that allows users to create and organize photo albums, upload photos and other memories, connect with friends, share Moments, collaborate on albums, interact with shared content and use related photo and memory services.

By creating an account or using Momentina, you acknowledge that you have read and understood this Privacy Policy.

2. Information We Collect

We collect only the information reasonably necessary to provide, secure and improve Momentina.

Account information

When you create or maintain a Momentina account, we may collect information such as:

  • Your name or display name
  • Username
  • Email address
  • Profile photograph
  • Account identifiers
  • Authentication information

Photos, videos and uploaded content

Momentina allows you to upload and store photographs, videos and other content that you choose to add to the Service.

This content may include associated information such as the date a photo was taken, upload date, location information or other metadata when such information is available and when the relevant device permissions and settings allow access to it.

Album and sharing information

We process information necessary to provide album and sharing functionality, including album names, categories, collaborators, viewers, sharing permissions, comments, reactions and related activity.

Friends and Moments

When you use Momentina's social features, we process information relating to friend requests, friendships, shared Moments, interactions and the people with whom you choose to share content.

Device and technical information

We may collect limited technical information necessary for security, diagnostics and reliable operation of the Service, such as device type, operating system version, application version, IP address, crash information and diagnostic data.

3. How We Use Your Information

We may use information collected through Momentina to:

  • Create and maintain your account
  • Store and display your albums and photos
  • Provide photo and video sharing functionality
  • Enable friendships, Moments and collaborative albums
  • Apply the privacy and sharing choices you select
  • Provide storage limits, subscriptions and rewards
  • Create photo books or other products you request
  • Process and fulfil print orders
  • Send important account and service notifications
  • Prevent fraud, abuse and unauthorized access
  • Diagnose technical problems and crashes
  • Maintain, protect and improve Momentina
  • Comply with applicable legal obligations

We do not use your private photographs simply because they are stored in Momentina for unrelated advertising purposes.

4. Your Photos Belong to You

You retain ownership of the photographs, videos and other content that you upload to Momentina.

Uploading content does not transfer ownership of that content to Momentina.

You grant us only the rights reasonably necessary to host, store, process, reproduce and display your content for the purpose of operating the features you choose to use. For example, we need to process a photograph in order to store it, generate appropriate image versions, display it in your album, share it with people you authorize, or prepare a photo product that you request.

5. Responsibility for Uploaded Content

Users are responsible for the content they upload to Momentina.

Momentina provides technology for storing, organizing and sharing user-provided content. We do not create, select or control the photographs, videos or other content that users choose to upload.

You are solely responsible for the content that you upload, store, share or otherwise make available through your Momentina account, subject to applicable law.

By uploading content, you represent that you have the necessary rights, permissions or other lawful basis to upload and use that content through Momentina.

You must not use Momentina to upload, store or share content that:

  • Violates applicable law
  • Infringes another person's copyright or intellectual property rights
  • Violates another person's privacy or other legal rights
  • Was obtained or shared without required authorization or consent
  • Contains unlawful or prohibited material
  • Is used to harass, exploit, threaten or harm another person

Momentina is not responsible for determining whether a user had permission to photograph a person or subject, whether the user owns the copyright to an uploaded image, or whether the user has obtained all consents required for uploading or sharing particular content.

Where permitted by applicable law, responsibility for user-generated content remains with the user who uploaded or shared that content.

We reserve the right to restrict access to or remove content, suspend functionality, or suspend or terminate accounts when we reasonably believe content or activity violates applicable law, the rights of others, our Terms of Service, or presents a security or safety risk.

6. Private and Shared Albums

Momentina is designed around user-controlled sharing. Content is not automatically made public simply because it has been uploaded to Momentina.

When you share an album or Moment, the content may become available to the people you have selected according to the permissions and features you choose.

Where supported, album participants may have different levels of access, such as viewer or collaborator access. Collaborators may be able to contribute content to an album depending on the permissions provided to them.

You are responsible for choosing the people with whom you share your content and for reviewing the sharing settings available to you.

Your memories, your circle. You decide who can access the albums and Moments you share.

7. Locked Albums

Momentina may provide additional privacy features such as album locking.

These features are intended to provide an additional layer of privacy within the application. They should not be considered a substitute for maintaining the security of your device, Momentina account, email account or device authentication credentials.

8. Photo Metadata and Location Information

Photographs may contain metadata created by your camera or device. Depending on the original file and your settings, this may include information such as the date and time the photograph was taken, camera information or geographic location.

Momentina may process available metadata to provide features relating to your memories. The availability and accuracy of metadata depend on the original photograph, device and permissions.

You should consider that photographs you choose to share may contain information about when or where they were created.

9. Camera and Photo Library Access

Momentina may request access to your camera and photo library so that you can capture photographs or select existing photos and videos to add to the Service.

These permissions are used to provide the functionality you request. You can manage application permissions through your device settings.

10. Sign-In Services

Momentina may allow you to create or access your account using third-party authentication providers, such as Google or Apple.

When you use a third-party sign-in provider, we receive only the information made available to us according to the authorization you provide and the provider's applicable settings.

Your use of a third-party authentication service is also subject to that provider's own privacy practices.

11. Payments and Purchases

Momentina may offer paid subscriptions, additional photo storage, photo books, printing services or other paid features.

Purchases made through Apple App Store or Google Play may be processed by the applicable platform provider. We do not necessarily receive or store your complete payment card details when payment is processed by those providers.

For physical products or print orders, we may process information necessary to complete and deliver your order, including contact and delivery information.

12. How We Share Information

We do not sell your private photographs or personal memories.

We may share or process limited information with service providers when reasonably necessary to operate Momentina. These may include providers supporting areas such as:

  • Cloud infrastructure and file storage
  • Authentication
  • Notifications
  • Application diagnostics and security
  • Payment processing
  • Printing and order fulfilment
  • Email or customer support

Such providers may process information only as required to provide their respective services and subject to applicable contractual and legal requirements.

We may also disclose information where required by law, valid legal process, or where reasonably necessary to protect the rights, security and safety of Momentina, our users or others.

13. Data Security

We use reasonable technical and organizational measures designed to protect personal information and uploaded content against unauthorized access, loss, misuse, alteration or disclosure.

However, no internet service, network transmission or electronic storage system can guarantee absolute security. You are responsible for keeping your account credentials secure and should not share your password with others.

14. Data Retention

We retain personal information for as long as reasonably necessary to provide Momentina, maintain your account, fulfil transactions, meet legal obligations, resolve disputes and protect the Service.

Photos and other content may remain stored while they are associated with an active account or where retention is necessary to provide features requested by the user.

Some Momentina plans or features may provide temporary recovery periods for deleted content. Content within an applicable recovery period may remain temporarily stored before permanent deletion.

Limited information may also be retained after account deletion where required by law, necessary for security or fraud prevention, or necessary to establish, exercise or defend legal claims.

15. Account and Data Deletion

You may delete individual content using the functionality available within Momentina and may request deletion of your account and associated personal information.

When an account is deleted, we will delete or anonymize associated personal information within a reasonable period, except for information that we are required or permitted to retain under applicable law.

Content previously shared with or contributed by other users may be subject to additional considerations where those users have independent rights or interests in that content or conversation.

16. Your Privacy Rights

Depending on where you live and the law that applies to you, you may have rights relating to your personal information, including the right to:

  • Request access to your personal information
  • Request correction of inaccurate information
  • Request deletion of personal information
  • Request restriction of certain processing
  • Object to certain processing
  • Request a copy or portability of certain information
  • Withdraw consent where processing is based on consent

17. Children's Privacy

Momentina is not intended to be used by children below the minimum age permitted to independently use an online service under applicable law without the authorization of a parent or legal guardian.

Users must not create accounts in violation of applicable age requirements.

Parents and guardians should carefully consider privacy before uploading or sharing photographs or other information relating to children and should ensure that they have any rights or permissions required by applicable law.

If we become aware that personal information has been collected from a child in circumstances prohibited by applicable law, we may take appropriate steps to delete that information or restrict the relevant account.

18. International Data Processing

Momentina may use technology and service providers located in different countries. As a result, information may be processed or stored outside the country in which you live.

Where required, we take appropriate measures designed to provide safeguards for international transfers of personal information in accordance with applicable data protection law.

19. Changes to This Privacy Policy

We may update this Privacy Policy as Momentina evolves, when our practices change, or when required by law.

When we make changes, we will update the "Last updated" date at the top of this page. If a change materially affects your privacy rights or how we use personal information, we may provide additional notice where appropriate or required by law.
